ORDINANCE NO. 613

AN ORDINANCE OF THE CITY OF HAWARDEN REPEALLING ALL OF TITLE 12 "PUBLIC UTILITIES" AND REPLACING IT WITH A NEW TITLE 12 ENTITLED "UTILITY SERVICE POLICIES, RATES, AND FEES" BY ESTABLISHING DEFINITIONS, CUSTOMER SERVICE POLICIES, GENERAL SERVICE POLICIES, SPECIFIC SERVICE POLICIES, AND UTILITY RATES AND FEES; PROVIDING A REPEALER AND SEVERABILITY CLAUSES AND AN EFFECTIVE DATE.

Whereas, written, updated, service rules in compliance with State Law are important in treating all citizens equally as public utilities are provided, and;

Whereas, proper service rules will ensure that utilities are safely and properly installed and provided, and;

Whereas, updated, service rules in compliance with State Law are important in treating all citizens equally as public utilities are provided;

BE IT ORDAINED By the City of Hawarden City Council as follows:

Section 1 Title 12 in its entirety is hereby repealed.

Section 2 That a New Title 12 be added entitled " Utility Service Policies, Rates, and Fees" as attached hereto.

Section 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 4. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.

Section 5. Effective Date. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
