NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF HAWARDEN, IOWA
Section 1. That Ordinance No. 553, Section 3.12 be amended to read as follows:

3.12 Compliance to Cable Television Regulatory Ordinance
The Grantee shall comply with all of the conditions and provisions of the Cable Franchise Regulatory Ordinance passed and adopted on January 6, 1997, unless an exemption or modification is so specified in this Franchise Agreement Ordinance.
A. The Grantee shall be exempted from compliance with the following section of the Cable Franchise Regulatory Ordinance:
6.9 Annual Report
8.10 Security Fund
8.11 Faithful Performance Bond

8.7 Effective Date. The effective date of this Franchise is February 21, 1997, pursuant to the provisions of applicable law. This Franchise shall expire on February 21, 2002, February 21, 2004 unless extended by the mutual agreement of the parties.

Section 2. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 3. Effective Date. This ordinance shall be effective upon the passage, approval and publication as provided by law.
