Whereas, Unit based pricing is being encouraged by the Department of Natural Resources as a way to encourage recycling, and;
Whereas, changes are needed to reflect current practices and State waste reduction mandates, and;
BE IT ORDAINED BY THE CITY COUNCIL OF HAWARDEN, IOWA:
Section 1. Chapter 6.08, Sections 6.08.010, 6.08.060 and 6.08.070, Section 6.08.140, Section 6.08.150, Section 6.08.230 and Section 6.08.240 of the Hawarden Municipal Code is hereby amended to read as follows:

6.08.010 Definitions, (17) adding a new (c):
(c) Recyclable Solid Waste - Are portions of the solid waste stream that are capable of being removed from the solid waste stream by composting, burning, re-sale for re-use, or other acceptable method that would otherwise prevent the material from being placed in a landfill.

6.08.060 Tree Limbs -- Bushes -- Disposal. Tree limbs less than four inches in diameter and bush shall be securely tied in bundles not larger than forty-eight inches long and eighteen inches in diameter when not placed in storage containers.
6.08.070 Yard Wastes -- Disposal. Yard wastes shall be stored in containers so constructed and maintained as to prevent the dispersal of wastes placed therein upon the premises served, upon adjacent premises, or upon adjacent public rights-of-way. The weight of any individual container and contents shall not exceed sixty-five pounds.
6.08.060 Prohibiting the Disposal of Organic Wastes -Tree Limbs, Bushes, Yard Wastes, Disposal. All organic wastes consisting of tree limbs, leaves, grass clippings, and other similar organic vegetative waste material shall be prohibited from being placed for normal solid waste pick-up. Such waste shall be mulched or composted on site, or shall be placed in the City's organic waste program. Tree limbs may also be placed for pick-up with the City's spring annual spring clean-up efforts. Small amounts of leaves and grass clippings may also be burned on site in accordance the standards contained in Chapter 8.08 of the Hawarden City Code.
6.08.070 Maximum Number of containers / Unit Based Pricing - The maximum number of containers for the weekly pickup shall be limited to no more than three containers. An additional fee equal to 1/12 of the monthly fee may be charged for each container above the three permitted. Unique items that do not meet the container requirements shall also be subject to a reasonable fee set by the waste hauler based on the costs to remove the item. The reasonable fee shall be based on the weight of item, and any special removal or disposal cost associated with the disposal of the item.

6.08.140 Collection Frequencies. The following collection frequencies shall apply to collections of solid waste throughout the City: All residential solid waste, other than bulky rubbish, shall be collected at least once twice weekly. All commercial solid waste shall be collected five times weekly, and shall be collected at such lesser intervals as may be fixed by the director upon a determination that such lesser intervals are necessary for the preservation of the health and/or safety of the public.
6.08.150 Container -- Storage Requirements. Residential solid waste containers shall be stored upon the residential premises behind any house front facing a public street. Said containers shall be placed for pick-up no more than 24 hours prior to and removed within 24 hours after any scheduled pickup. Commercial solid waste containers shall be stored upon private property, unless the owner has been granted written permission from the City to use public property for such purposes. The storage site shall be well drained; fully accessible to collection equipment, public health personnel and fire inspection personnel.

6.08.190 Disposal -- Location. All solid wastes shall be disposed of at a processing facility the Northwest Iowa Area Waste Agency Landfill Facility or disposal area approved by the City and complying with all requirements of the Department of Environmental Quality Natural Resources.

6.08.230 Service Charges. There is imposed, for the collection and disposal of solid waste, a service charge for each dwelling unit and each institutional, commercial and other business establishment to which such service shall be provided under the provisions of this chapter. The dwelling unit service charge shall be set by the city council, by ordinance per calendar month. The service charge for each institutional, commercial, industrial and other business establishment will be determined by the director on the basis of quantity and characteristics of material, point of pickup, and time required to collect the solid waste, if service is performed by the City. A gate charge may shall be set by the City Council.

6.08.250 Recycling. Recycling is encouraged for every generator of solid waste in the City. The City encourages every generator to continue to assist the City in meeting an established DNR mandated goal of 25% for overall solid waste reduction. A portion of the monthly solid waste fees charged shall be for recyclable solid waste collection. Specified recyclables shall be picked up twice monthly at each residence. The director shall establish the specified recyclables eligible for pick-up and shall make information on specified recyclables available to citizens. The director shall also coordinate solid waste recycling with non-residential generators based on their specific recyclable solid waste generation.

Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
