Section 1. Amendment. Chapter 12.08 of the Hawarden Municipal Code is hereby amended as follows:

12.08.010 (2) Wholesale Gas Adjustment Charges
The rates established by 12.08.010 (1) of this Ordinance shall be increased for each full cent increase above the established upper MCF cost threshold. In addition, the rates established by 12.08.010 of this Ordinance shall be decreased for each full cent below the established lower MCF cost threshold. The threshold cost shall be based on all the costs incurred to receive gas at the point of demarcation at the Ventura Index. The upper threshold cost shall be set at $2.75 per MCF and the lower threshold cost shall be set at $2.00 per MCF.

Section 2. Repealer. All ordinances or part of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 4. Effective Date. This Ordinance shall be in effect after its final passage, approval and publication as provided by law.
