AN ORDINANCE OF THE CITY OF HAWARDEN AMENDING CHAPTER 9 OF THE HAWARDEN MUNICIPAL CODE BY CREATING A NEW SECTION, "9.06" ENTITLED " OBSTRUCTION OF SIDEWALKS, STREETS, HIGHWAYS AND OTHER PUBLIC WAY OR INTERFERENCE WITH TRAFFIC FLOW"; AND ADDING A REPEALER AND SEVERABILITY CLAUSES AND AN EFFECTIVE DATE.
WHEREAS, there has been complaints regarding the obstruction of streets, sidewalks and other public ways, and;
WHEREAS, such obstructions present a safety problem for the motorists and pedestrians around these obstructions.
BE IT ORDAINED by the City Council of Hawarden, Iowa as follows:
Section 1. Amendment. Chapter 9.06 of the Hawarden Municipal Code is hereby created as follows:
9.06.010. Obstruction of sidewalks, streets, highways, and other public way or interference with traffic flow:
No Person shall, without proper authority or justification, obstruct any sidewalk, street, highway, or other public way preventing or hindering its lawful use in any way, or shall any person interfere with or obstruct the flow of traffic on any street, highway, or other public way.
Anyone who violates any of the provisions of this chapter shall, upon conviction, be subject to imprisonment of not more than 30 days and or a fine not exceeding $500.00.
Section 2. Repealer. All ordinances or part of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof, not adjudged invalid or unconstitutional.
Section 4. Effective Date. This Ordinance shall be in effect after its final passage, approval, and publication as provided by law.
