WHEREAS, There are some potential new customers for the system that get their television programming via satellite dish or other means, except for some of the local programming, and
WHEREAS, The Citizen's Programming Committee has reviewed the proposal and recommends that a local station package be adopted;
BE IT ORDAINED by the City Council of Hawarden, Iowa as follows:
Section 1. Amendment. Chapter 12.44, (C) Monthly Rates of the Hawarden Municipal Code are hereby amended as follows:

C.) Monthly Rates:
Local Station Package $ 9.95*
Basic Tier $22.50 per month
A la Carte Service (Showtime) $10.95 per month **
A la Carte Service (HBO) $ 9.95 per month **
A la Carte Service (Cinemax) $ 7.50 per month **
* The local station package may not be combined with any of the A la Carte Services
** An A la Carte Service may not be purchased without purchasing the Basic Tier Package.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect August 1st after its final passage, approval, and publication as provided by law.
