ORDINANCE NO. 579
AN ORDINANCE REVISING GARBAGE RATES

WHEREAS, The cost of fuel used by the City's solid waste contractor, Independent Waste, has risen above $1.50 and;

WHEREAS, The Mayor and City Council are concerned that the collection contract remain advantageous to both the City and the contractor by ensuring that it is adaptable to large market fluctuations in some commodities and;

WHEREAS, There is currently no provision to allow a fuel surcharge in our present ordinance as written.

BE IT ORDAINED by the City Council of Hawarden, Iowa as follows:

Section 1. Amendment. Chapter 12.50 of the Hawarden Municipal Code is hereby amended as follows:

      12.50.010 Monthly Garbage Base Rates. The following garbage collection rates shall apply:

Residential	$10.99 per month
Commercial	$3.00 per month

      12.50.0 20 Additional Garbage Charges above Base Rates. Additional garbage charges shall apply as provided for in the City's Solid Waste Collection Contract. [Click here to see the contract changes]

Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.

Section 4. Effective Date. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
