WHEREAS, The costs of providing the cable service has increased and;

WHEREAS, The cable rates have remained the same for three years, yet six new channels with their applicable programming costs have been added as ongoing expenses, and;

WHEREAS, Additional monies are needed to cover the capital expenses and other operating expenses of providing the service.

BE IT ORDAINED by the City Council of Hawarden, Iowa as follows:

Section 1. Amendment. Chapter 12.44, (C) Monthly Rates of the Hawarden Municipal Code are hereby amended as follows:

C.) Monthly Rates: (Red Text: Old Rate. Blue Text: New Rate)

Basic Tier	$21.00  $22.50 per month
A la Carte Service (Showtime)	$10.00  $10.95 per month
A la Carte Service (HBO)	$ 7.50   $9.95 per month
A la Carte Service (Cinemax)	$ 7.50 per month

Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

Section 3. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof, not adjudged invalid or unconstitutional.

Section 4. Effective Date. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
