MINUTES - CITY COUNCIL MEETING

The meeting was called to order at 7:00 p.m.

Present: Mayor Porter; Council members: Cauwels, Dorhout, Woodley, Kallsen, Harvey.

Absent: None.

Staff Present: Craig Coffey, City Administrator; Tom Kane, Public Works Director; Chris Myres, Telecommunications Director; Mike DeBruin, Police Chief; Jim Pickner, City Attorney.

Standard Agenda Items

Item 1a. Approval of November 5, 2001 Minutes. Moved by Woodley/Kallsen to approve the Minutes of November 5, 2001. Motion carried unanimously.

Item 1b. Approval of Claims for Payment. Moved by Cauwels/Dorhout to approve the Schedule of Claims for payment. Motion carried unanimously.

Item 1c. Open Business from the Community (limited to a maximum of 5 minutes per item.) There was no open business from the community.

Item 2a. Staff Reports/Discussion.

Item 2b. Mayor Report. Mayor Porter announced that he had received an invitation honoring Robert Nohava who will be getting his Eagle Scout award. He congratulated Roy Lubkeman and Jeff Nohava on the Council election and also reminded everyone on the upcoming Tree Lighting Ceremony to be held on Friday, November 23rd at 5:00 p.m.

Item 3. Second Reading of Amended Ordinance No. 596- AN ORDINANCE OF THE CITY OF HAWARDEN AMENDING TITLE 9, CHAPTER 9.03 BY ADDING A NEW SECTION 9.03.01 ÒPRESUMPTION IN REFERENCE TO ILLEGAL PARKINGÓ, RENUMBERING CHAPTER, AND REPLACING AN EXISTING SECTION RENUMBERED FROM 9.03.09 TO 9.03.10 BY ADDING STANDARDS LOWERING THE WEIGHT LIMIT OF PROHIBITED VEHICLES, PROHIBITING VEHICLES OVER 25 FT. IN LENGTH, AND PROHIBITING NON-MOTORIZED VEHICLES FROM PARKING IN THE RIGHT OF WAY OF RESIDENTIALLY ZONED AREAS; PROVIDING REPEALER AND SEVERABILITY CLAUSES AND AN EFFECTIVE DATE. Moved by Woodley/Harvey to approve the second reading of Amended Ordinance No. 596. Motion carried unanimously.

Item 4. Discussion of Old City Hall (Community Center) Use Policies. Major problems have arisen recently in the rental of the City Hall for dances and parties including broken bottles, public intoxication, alcohol without a license, fights, large gatherings on the streets and trashing the restroom facilities. Chief DeBruin and Mr. Coffey talked to the Council regarding the policies of the rental of the City Hall and proposed some changes to help correct the overall problem. One sentence regarding reservations was eliminated. Moved by Woodley/Kallsen to approve the proposed changes to the Old City Hall Rental Rules. Motion carried unanimously.

Item 5a. Approval of Wee Care Lease and Resolution 2001-38 to Advertise the Property for Lease. Discussion ensued about the calendar for the project. Some changes were suggested by the City Attorney on the resolution including a "WHEREAS" identifying the lease as a public purpose. The following text was added "WHEREAS, The location of a larger, quality, child care facility is deemed to be a valid public purpose, by providing affordable daycare services for families and employers and furthering the overall public health, safety, economic order, and general welfare of the community." Moved by Dorhout/Cauwels to approve Resolution No. 2001-38 as amended to advertise the property for lease. Aye: Cauwels, Dorhout, Woodley. Nay: Harvey, Kallsen. Motion carried.

Item 5b. Approval of Wee Care Lease. Moved by Woodley/Cauwels to table the Wee Care Lease until the December 3rd Council Meeting. Motion carried unanimously.

Item 6. Review of Personnel Manual and Resolution 2001-37 - A Resolution Adopting Personnel Handbook. Changes were suggested in the harassment section and regarding various provisions regarding ambulance personnel. Moved by Woodley/Cauwels to postpone approval of the Personnel Manual and Resolution No. 2001-37 until the December 3rd Council Meeting. Motion carried unanimously.

Moved by Kallsen/Woodley to adjourn. Motion carried unanimously. The Council Meeting adjourned at 8:10 p.m.
